What does a claimant representative do to help a claimant document disability?
Every case is somewhat unique so a claimant representative may do more or less with one person than with another but, in general, claimant represetatives will address the following activities with and for a claimant.
Compile work records to document Social Security eligibility;
- Obtain medical reports from doctors that present the claimant's grounds for disability;
- Obtain a copy of the claimant's Social Security file and confirm its accuracy or correct it;
- Compare the claimant's circumstances to Social Security regulations:
- Compare the claimant's circumstances against existing law and precedents;
- Write a legal brief of assertions documenting the claimant's disability;
- Prepare the claimant and her or his witnesses to testify at the claimant's court hearing;
- Question physicians and others at the hearing to lend evidence to the claimant's case;
- Protest, at the court hearing, the introduction of any inadmissible or inaccurate information against the claimant.
Presumably the review of this list of activities explains the wisdom of using a claimant representative. Experience and access to specialized libraries and other information sources reside with the claimant representative.
